Fatal officer-involved shooting outside Martin's ruled justified

ELKHART COUNTY, Ind. -- The Elkhart County Prosecutor's Office announced Friday that, after reviewing investigative materials regarding the officer-involved fatal shooting of 54-year-old Juan M. Sanchez outside of Martin’s Super Market on Jan. 27, the use of deadly force was justified.

Officials say no criminal charges will be filed against Cpl. Vandenburg or Patrolman Pasternak arising from the incident.

Documents say Pasternak was the first to arrive on scene less than two minutes after the initial shooting occurred inside Martin's.

Officials say upon arrival he was directed south from Martin’s main entrance.

Pasternak then proceeded around the east perimeter of the nearby apartment building.

Documents state as he ran south, he saw two men on the sidewalk between the parking lot and the building.

While Pasternak was assessing the threat level of each of those men, one, later identified as Sanchez, pulled a handgun from his coat pocket and fired at Pasternak.

Documents state that's when Pasternak returned fire.

Pasternak was shot through his elbow area by Sanchez. The bullet exited, then went into his chest/torso area.

Partially incapacitated by the gunshot wound, officials say Pasternak continued to fire at Sanchez.

Sanchez had turned and fired at Vandenburg, who had arrived and followed Pasternak's path.

Pasternak continued shooting at Sanchez until the threat from him was neutralized.

Documents state Vandenburg had arrived and was at the southeast corner of the apartment building, trying to direct two bystanders away from the area.The bystanders appeared to be trying to video record the event with a phone, according to Vandenburg.

Vandenburg observed Sanchez turning toward him and firing, at which point he returned fire.

Vandenburg was also struck by Sanchez’s gunfire in the elbow area.
