The case was continued to Feb. 13.
Court documents from La Porte County reveal for the first two cases a motion was filed to remand to state court again by the plaintiffs' attorney.
The plaintiffs argued there is not diversity jurisdiction with La Porte and St. Joseph Counties being involved and that Amazon failed to prove the argument required to remove the cases to federal court.
In Shails vs. Akison, the court denied Shails' motion to stay except for proceedings.
Richard Shail, a volunteer JV baseball coach, filed the lawsuit against Enterprise, Amazon, Rent-a-Car, and St. Joseph County as well.
In JV vs. Akison, the court ordered a recusal and reassigned the case to the same federal judge handling the prior case, Damon Leichty.
This lawsuit was filed on behalf of Jackson Vanlue, who is a minor. It's also against Enterprise, Rent-a-Car, St. Joseph County, and Amazon.
The newest civil lawsuit, Henrich vs. Akison, was removed to federal court and was also reassigned to Leichty.
This lawsuit was filed by Ryan and Christy Henrich, parents of Nickolas Henrich.
Nickolas was a passenger injured in the New Prairie bus crash. According to the lawsuit he suffered personal injuries, some of which are permanent.
On May 8, 2025, deputies arrived on scene to find several student-athletes and a bus driver were injured. One 16-year-old student-athlete, later identified as Lucas Bradshaw, suffered critical injuries and was airlifted to the hospital unconscious in a coma, with a double brain bleed. Bradshaw had been ejected from one of the buses.
Through witness statements and investigation on scene, it was learned that Akison was traveling west at a high rate of speed when he attempted to pass slowed/stopped traffic near Fail Road, driving through the turn lane.
