JULY 22 UPDATE: After pleading guilty back in May, Martin Burns was sentenced to a year in jail late last week. That one-year sentence was suspended and Burns will be placed on probation for 361 days. 

UPDATE: Martin Burns was found guilty of Battery on a Person Less than 14 Years Old, a Level 6 Felony, on May 13, according to recently obtained court records.

Burns was found not guilty of Battery Resulting in Bodily Injury.

ORIGINAL: PULASKI COUNTY, Ind. - A Winamac pastor seen kneeling on a child at a church daycare will make his initial court appearance on Thursday after being charged in connection with the incident.

The pastor, identified as Martin Burns, has been charged with battery on a person less than 14 years old and battery resulting in bodily injury.

He has not been booked into jail.

Back in September, ABC57 News obtained video of Burns kneeling on a child while apparently trying to get the child to let go of his leg at the Kingdom Kids Daycare at Winamac Church of the Nazarene.

The child seen in the video was not injured.

According to the probable cause affidavit, Burns was kneeling on the child for approximately seven seconds before he stood up.

Burns told police he used just enough pressure to hold the child down, according to police reports.

ABC57 News has reached out to the church for comment.
