Two plead guilty to Murder in fatal shooting, third gets trial date

ELKHART, Ind. -- Court documents from Elkhart County reveal Stepphon Sutton entered a guilty plea agreement for the November 2024 murder of 32-year-old Toby Fisher, of Elkhart, on Aug. 1 for his role in the case.

Sutton's sentencing is scheduled for Sept. 4

Ashley Seabolt was also charged in this case. She pleaded guilty to Murder on July 3 and is set to be sentenced on Aug. 21.

A third suspect, Sami Hussen, has a jury trial for Murder scheduled for Oct. 20.

On Nov. 26, 2024, the Elkhart Police Department responded to the 700 block of Monroe Street after receiving a call around 6:55 p.m. regarding an unresponsive 32-year-old, later identified as Fisher, who had an apparent gunshot wound.

Fisher died at the scene.

In the probable cause affidavit for this case, it's revealed authorities obtained security video from River Run Apartments and the nearby Rebel Gas Station.

Through witness statements and video footage, it was learned Seabolt had been trying to set up a drug deal with Hussen, involving methamphetamine and fentanyl.

The plan led to Sutton, Seabolt, Fisher, Hussen, and a witness in a white Honda Accord at River Run Apartments.

Documents state Seabolt got out of the Honda, at which point Fisher aimed his gun at Hussen and the witness, demanding money and the witness' purse.

The witness then heard gunshots and ran from the vehicle.

Sutton then exited and ran off with her purse.

Once the witness was back in the Honda, Hussen was the only occupant, in the driver's seat.

He told the witness he wasn't sure if he "hit" the guy or not. The witness told police Hussen was known to have a gun.

The witness stated Hussen acted in self-defense.

In December 2024, investigators downloaded the contents of Fisher's phone and found messages between Seabolt and him on Nov. 26.

Seabolt told Fisher she has a "great plug" who will bring "ice," "xanex," and "fetty."

Police say Sebolt went on to provide detailed instructions to Fisher on how to commit this robbery, including "tell him and his girl to empty out there pockets" and "purse take there phones everything."

Fisher also messaged Seabolt, "I got a hammer now too," of which police know "hammer" to mean a gun.

When later interviewed, Seabolt said she set up a drug deal between Fisher, Hussen, and herself that night. She added she had picked up Sutton and Fisher from Three Rivers that day.

She said when she exited the car at the apartments, it was to grab more money for drugs.

She told police when she was returning to the car, that's when she heard gunshots and ran from the area.
