Thomas McCoy sentenced for deadly OWI crash with pedestrian

ST. JOSEPH COUNTY, Ind. -- The St. Joseph County Prosecutor's Office reports 58-year-old Thomas McCoy has been sentenced after pleading guilty to the grand jury’s indictment of Operating a Vehicle with an Alcohol Concentration Equivalent of 0.15 or More, a Class A Misdemeanor, in the Oct. 18, 2025, crash that killed 27-year-old Adrian Antonio Cruz of South Bend.

McCoy pled guilty on Feb. 18 and has been sentenced to the maximum sentence of one year, with six months on home detention and six months suspended on probation.

McCoy's second count, Operating a Vehicle While Intoxicated, a Class C Misdemeanor, was dismissed.

Under the probation terms, McCoy is required to complete a substance abuse evaluation and follow up treatment, complete a victim impact panel, and consume no alcohol.

McCoy's driving privileges were also suspended for 90 days, with retroactive credit.

Police determined on Oct. 18, 2025, that a passenger vehicle, driven by McCoy, was traveling north on Pine Road when he struck Cruz who was walking north in the roadway.

McCoy and his passenger were uninjured. Cruz was pronounced dead at the scene.
