UPDATE TWO: Elkhart Police Department officials released formal charges against the suspect, 38-year-old Paul Lundy.

• Two counts of Resisting Law Enforcement (both felonies)
• Criminal Vandalism (misdemeanor)
• Public Nudity (misdemeanor)

Officials say he is currently in custody at the Elkhart County Jail.

UPDATE: Police announced the suspect involved in the incident at Beardsley Elementary School Tuesday morning has been arrested on several preliminary charges after initially being released from custody at the hospital for an extended period of medical treatment due to pre-existing medical conditions.

Authorities say at the time, they had no information indicating the suspect posed an immediate threat to the public.

EPD decided to continue with an out-of-custody charging process and began preparing a criminal case packet and warrant request for submission to the Elkhart County Prosecutor’s Office for review and consideration of appropriate charges.

The suspect was then released from police custody. Police said at around 12:23 p.m., a call came in that the suspect fled Elkhart General Hospital on foot with medical equipment still attached to him.

Officers returned to the area and found the suspect near S. Highland Avenue and W. Lexington Avenue.

The report states the man would not comply with officers' commands, which led to a taser and chemical irritants being used on him.

Police detained and arrested the man at about 12:31 p.m. Medics evaluated the suspect at the scene before taking him back to the hospital.

The suspect's preliminary charges include Criminal Trespass, four counts of Resisting Law Enforcement, Public Indecency, and Theft in connection with both incidents.

He will remain in EPD custody at the hospital pending medical clearance. Once cleared, he will be taken to Elkhart County Jail.

ORIGINAL STORY: ELKHART, Ind. -- A 38-year-old man is in custody as a local hospital after running from Elkhart police Tuesday morning following a report of a suspicious man looking in the windows of Beardsley Elementary School.

The Elkhart Police Department reports a 911 call came in around 8:49 a.m. about a man jumping the perimeter fence as the school before looking in windows.

Officers responded to the scene and attempted to speak with the man, who subsequently fled on foot.

During the pursuit, police say the man jumped into the St. Joseph River where he then hid under a boat.

Police gave the man several verbal commands to exit the river before they used pepper balls to get him to comply.

Police then pulled the suspect from the river at which point authorities say he continued to resist them.

The suspect was evaluated by medics on scene before being taken to the hospital for medical clearance. As of 11 a.m., Tuesday, the man is still in custody at the hospital.

He's in custody for preliminary charges in connection with this incident.

Police say the suspect’s name will be released if and when an Elkhart County judicial officer finds probable cause for this arrest. No other injuries were reported in this incident.

Beardsley was on lockdown during the incident and police say the man never entered the school.

Officers did make a secondary sweep of the school area and found no weapons or anything of immediate safety concern.

EPD believes there to be no further threat to the public.
