Prosecutor's office deems officer-involved shooting with Winamac man self-defense

CHESTERTON, Ind. -- The Porter County Prosecutor's Office announced on Monday the officers involved in officer-involved shooting regarding 45-year-old Joseph Gerber, of Winamac, on June 18, acted in self-defense.
Porter County Prosecutor Gary S. German stated Officer Mancera and Lieutenant Virijevich acted in self- defense without question, and that they were not only protecting themselves but also numerous members of the public.
On June 18, police were called to the Hilton Garden Inn in Chesterton for a reported unwanted individual.
The hotel staff reported Gerber had stayed overnight but wasn't a registered guest. They went on to say Gerber had been acting "distant" and had a firearm in his possession
Documents state the officers' initial contact with Gerber involved what are commonly called de-escalation techniques for several minutes but were unsuccessful.
As Gerber was being escorted from the hotel, he became more agitated and when asked to further identify himself, he backed away from the officers before running away.
Documents state while Gerber was fleeing with officers right behind, he reached behind his back, pulled out his firearm, turned, and shot Mancera.
Both officers returned fire striking Gerber several times.
Documents state Gerber continued to fire his weapon at the officers before he turned the weapon on himself.
Gerber's later autopsy determined he died of a self-inflicted gunshot wound.
Gerber's toxicology results also indicated the presence of a significant amount of methamphetamine in his system.
At the time, Gerber had an active warrant for his arrest for an alleged violation of the terms of his home detention.
German wrote in his statement, "The active warrant for his arrest obviously explains why he chose to flee from the police. In summary, the actions of both Officer Mancera and Lieutenant Virijevich demonstrated their high level of training, professionalism and courage. I consider this investigation and case closed."
