18-year-old faces several charges of Possession of Child Sex Abuse Material

ELKHART COUNTY, Ind. -- Court documents from Elkhart County reveal a teen has been charged with Possession of Child Sex Abuse Material after authorities received a cyber tip from the National Center for Missing and Exploited Children.

The suspect, 18-year-old Roberto Vilchez Garfias, has been charged with Child Exploitation, a Level 4 Felony, three counts of Possession of Child Sex Abuse Material with aggravating factor, Level 5 Felonies, and three counts of Possession of Child Sex Abuse Material, Level 6 Felonies.

His initial court hearing is Thursday afternoon.

Documents state on Sept. 23, a member of the Elkhart County Sheriff's Office reviewed several files connected with the cyber tip. The tip implied the materials were apparent child pornography.

Authorities say the electronic service provider geo located the IP address to Elkhart. The cyber tip listed the Kik account username Robert_the_opp6243, later found to belong to Garfias.

The probable cause affidavit shows authorities reviewed at least seven video files which showed sexual activity involving adult men and children.

A search warrant was granted for the username Robert_the_opp6243 from MediaLab/Kik on Oct. 8 for the period between April 29 and May 7, when the videos were sent.

Law enforcement says a conversation was found between Garfias and other users which showed the video files matching the cyber tip.

Documents show on Dec. 9, a residential search warrant for a home in the 800 block of Rinehart Place in Elkhart was applied for and approved. This included a warrant for electronic devices in the home, including any device able to store or transmit images or videos.

Garfias was read his Miranda Rights and agreed to speak with deputies. When asked if he knew why authorities were there, Garfias said he did, and it was due to child pornography.

Documents state Garfias told investigators he had child porn on his phone, and he'd acquired it when he was added to groups in an app called Sessions.

Garfias told authorities he'd started obtaining child porn when he was 15 or 16 years old. He claimed he'd most recently seen the child porn six months ago, around June. That's when he said he realized he still had it, so he deleted it.

Garfias then agreed to let authorities look through his phone for the child sexual abuse material, which was found in the "Secure Folder" on his phone.

Investigators say they observed a video of child sexual abuse material had been sent to someone on the Sessions app in an apparent attempt to join a group which shares the same material.

The time stamp the video was sent was in September, when Garfias was 17. He turned 18 on Oct. 18.

Another conversation in Sessions showed a November time stamp.

Investigators say Garfias admitted to distributing child sexual abuse material but never made any himself.

He stated he sent no less than 10-15 videos of child porn.
