Zach Anderson re-sentenced
A Berrien County judge has re-sentenced Zachery Anderson just one month after a trial court vacated his previous sentence.
In court Monday, Anderson was sentenced to 2 years probation, will be allowed to use a computer for classes.
He will also be on the sex offender registry in Indiana while on probation.
He will not be on the Michigan sex offender registry.
Anderson pleaded guilty to criminal sexual conduct 4th degree in March 2015.
Anderson was sentenced on April 27, 2015 to 90 days in the Berrien County Jail, 5 years probation and the request for sentencing pursuant to the Holmes Youthful Training Act (HYTA) was denied.
That sentence was vacated in September 2015 after a trial court judge ruled the prosecutor violated the plea agreement by implying the court shouldn't grant HYTA.
Anderson's family is happy with the resentencing
"The first one was unfair he had no chance to have a normal life without granting HYTA and honestly if this was the verdict in the first one, nobody would have met us. We probably would have never been through this," said Lester Anderson, Zach's dad.
Zach admitted to having sex with a girl he met on a dating app called Hot or Not. The victim said she was 17, but she was actually 14-years-old.
