South Bend Council member McBride files motion to dismiss civil lawsuit over residency claims

SOUTH EBND, Ind. -- On Aug. 28, South Bend Common Council member Sharon McBride, who represents District 3, filed a motion to dismiss a civil lawsuit alleging she has not lived in her district for an extended period of time.
McBride had a hearing on Wednesday, where the plaintiff, Brian Collier, said he doesn't want to give a written response because a motion to change the venue is still pending.
Collier said no further discovery is needed, but McBride's lawyers gave 90 days for potential discovery.
The court said it will issue orders "as soon as practicable."
The motion states the plaintiff lacks standing due to lack of jurisdiction and for failure to state a claim.
According to the municipal code of the City of South Bend, "Any councilmember representing any district [who] ceases to be a resident of such district ... such office shall thereby become immediately vacant."
