Man found in library parking lot with teen charged with Sexual Misconduct with a Minor

NAPPANEE, Ind. -- Court documents from Elkhart County reveal 23-year-old Marco Almiray Pujol was arrested and charged with Sexual Misconduct with a Minor, a Level 5 Felony, and Contributing to the Delinquency of a Minor, a Level 6 Felony, following an incident on Labor Day.
Pujol's due in court for his first hearing on Sept. 10.
The Nappanee Police Department reports on Labor Day, around 12:32 a.m., two officers on patrol in the city observed a suspicious vehicle in the parking lot of the Nappanee Public Library.
Police saw a female in the passenger's seat. When officers approached the vehicle to speak with the girl, later identified as the victim, they noticed a man, identified as Pujol, in the driver's seat.
When officers asked the two what they were doing, Pujol stated he was dropping the victim off at her friend's house nearby.
Police asked the victim how old she was, to which she said 15. Pujol said he was 23.
Pujol was then informed he could be charged with Contributing to the Delinquency of a Minor, since the victim was out past curfew.
While speaking with the two, police could see Pujol had his shoes off and there was belt in the back seat of the vehicle. Police also noted the victim was wearing a revealing outfit with no bra.
Pujol told police they had just pulled into the parking lot 10 minutes beforehand after attending the Blueberry Festival.
The two also told police the victim's friend, another juvenile, had been with them in the car, but left the two alone when they parked in the lot and walked home.
Police learned the parents of both juveniles didn't know they had been with Pujol, nor did they know who he was.
Police say while speaking with Pujol, they became convinced Pujol had inappropriate sexual contact with the victim.
Pujol was then taken into custody and read his Miranda Rights.
When later interviewed at the police department, Pujol told police he'd been in contact with the victim for several months. He agreed she looked young but stated he didn't know if she was 18 and didn't want to ask.
He admitted he was hesitant to date her due to her possibly being underage. Pujol told police he didn't find out the victim was 15 until he overheard her and her friend discussing their ages at the Blueberry Fest.
Pujol said once the victim's friend left them alone in the library parking lot, he reclined his seat and had the victim sit on top of him, at which point he touched her inappropriately until police arrived, which is when they stopped.
