Man charged with three counts of domestic battery, victim given emergency plastic surgery

ST. JOSEPH COUNTY, Ind. -- The St. Joseph County Prosecutor's Office has released the probable cause affidavit regarding a domestic violence incident which occurred on Jan. 26, leading to a man being arrested.

Documents state an officer with the Mishawaka Police Department responded to the St. Joseph Medical Center on Jan. 26, to talk with a victim regarding a battery which happened around 5:30 a.m. that day.

The victim told police it happened at her residence on Heritage Court. The victim stated the attacker was her boyfriend Bryan Gillespie, who had previously contacted her about wanting to come over to her place.

Police say the victim told Gillespie that it'd be best if he didn't. The victim told police he came over anyway a couple hours prior to the assault.

The victim told the authorities she believed the fight had started because she told Gillespie to leave. Documents state that's when the argument turned physical inside the home near the front door and staircase.

The victim stated Gillespie was hitting her with a blunt object in his hand. She said at this point she was on the floor being beaten.

The victim told police she believed the blunt object to possibly be a broomstick.

The victim stated she received a laceration to her hand as a result of putting her hand in front of her face for protection. She told the police it happened so fast it was hard for her to recall all of the details.

The victim added that during the assault, Gillespie had stomped on her several times while wearing his shoes. She told police when he stopped the assault, Gillespie left, and she drove herself to the hospital.

Documents state the victim and Gillespie have been in an on and off relationship for around three years.

The victim told the authorities she thought Gillespie was going to kill her during the incident, and that he has battered her in the past, even shooting a firearm at her a few months ago.

The victim added that Gillespie has also strangled her several times in the past.

An officer at the medical center observed a large laceration around the victim's eye, but he could not determine how extensive it was at the time. Authorities also observed a laceration on the victim's hand.

Documents state officers with the South Bend Police Department found Gillespie at a residence on Coleman Street, before being taken to the St. Joseph County Jail.

Gillespie was advised of his Miranda rights at the jail, where he then told police he and the victim had gotten into an altercation at her house, but stated he was trying to leave when the victim tried to grab him

Gillespie told the police he pushed her hard and she hit her head on the staircase. He added that the victim was injured but pleaded with him to not contact emergency medical services.

Documents state officers looked in the victim's home and observed red stains all over the entryway floor.

Police say there was also a grey broom lying at the bottom of the stairs, just inside the apartment.

Documents state there was also a red stain in the hallway and what looked like a large piece of flesh on the hallway floor.

Police looked at the railings for the stairs, with the railing closest to the door having a red stain on top of it, but no other indication that someone struck their head. Documents state the railing at the top had no red stains on either end.

An officer later went back to St. Joseph Regional Medical Center to let the victim know Gillespie had been arrested.

While the officer was there, the nurse was taking a bandage off of the victim's forehead, where he observed a large open wound above the victim's left eye that was roughly the size of her eye socket.

Later in the day, the same officer went back to the hospital on an unrelated call, and while there, spoke with the nurse about the victim's injury.  

The nurse said the victim's wound was so severe that she was taken for emergency plastic surgery as the ER physician was unable to close the wound. The victim was taken to Ft. Wayne Lutheran Hospital for the surgery.

Gillespie is charged with Domestic Battery Resulting in Serious Bodily Injury, Domestic Battery Resulting in Moderate Bodily Injury, and Domestic Battery.

His initial hearing is set for Feb. 12 at 9 a.m.
