The Albion Police Department reports Kimberley Cates was pulled over around 10:09 p.m. at Main and Oak Street.

Police say Cates had red and glassy eyes, was unbalanced, and the officer smelled the odor of an alcoholic beverage.

The report states Cates refused a chemical test.

Later at 1:03 a.m. on Sept. 26, a blood sample was taken. The results of the alcohol/drug test are pending.

Cates is charged with Operating a Vehicle While Intoxicated: Prior Conviction Within 7 Years, a Level 6 Felony.

She was previously convicted of Operating a Vehicle While Intoxicated Endangering a Person on Aug. 30, 2024, in Kosciusko County.
