Judge recuses self from lawsuit case between Attorney General Rokita and SJCPD

On June 18, the court held a hearing on defendants, Redman, in his capacity as sheriff, and SJCPD's motion to dismiss, where no decision had been made.
The order of recusal states the court has discerned a possible conflict of interest which could present an appearance of impropriety if the court continued to preside over the case.
The document goes on to state the further participation of Broden in this matter would potentially violate the Canons of the Indiana Code of Judicial Conduct.
As stated in the order of recusal:
"Pursuant to St. Joseph County Local Rule 71-TR79, Rule 216.1, the parties will have seven (7) days from the date of this Order to agree upon a Special Judge in this case. The Court will monitor the chronological case summary in this matter and if the parties cannot agree upon a successor judicial officer, the Court will promptly refer this matter to the Clerk of the St. Joseph Circuit Court for a random selection of a Special Judge."
