City of Niles settles lawsuit with mother of 2022 shooting victim

NILES, Mich. — The City of Niles settled a lawsuit with Rochelle Smith, mother of Demi Galvin, who was shot and killed in 2022.

Smith sued the city, the Southwestern Michigan Community Ambulance Services (SMCAS), and a number of Niles police officers, alleging first responders did not employ all proper lifesaving measures to save Galvin after the shooting.

Five teenagers were shot on N. Sixth Street in Niles just before midnight on Sept. 20, 2022. Two girls died: 18-year-old Yasmeen Scott and 15-year-old Demi Galvin. The shooting is believed to be a retaliatory strike following two prior shootings in the same area. No arrest has been made for the mass shooting.

Smith's son, Kyren Miller, is also a plaintiff in the lawsuit. He was injured in the same shooting that killed Galvin, but survived, and his telling of events largely informed the lawsuit.

ABC57 obtained documents showing a settlement agreement has been reached and the lawsuit is ordered to be dismissed. On Wednesday, the Niles City Administrator confirmed the settlement was for $5,000 for each plaintiff.

The Order to Dismiss also states it does not close the case.

ABC57 reached out to the City of Niles, the Niles Police Department, SMCAS, the attorneys for the defendants, and Rochelle Smith, who had been representing herself since her attorney, John Beason III, was suspended in May 2025. ABC57 obtained the order showing his suspension, but it does not specify why he was suspended from practicing law.

City Administrator Ric Huff sent ABC57 the following statement:

"This incident was a tragic loss of life, and the City of Niles is committed to holding the responsible parties accountable for this violence."
