Two South Bend men arrested for Theft and Resisting Law Enforcement in Elkhart

ELKHART, Ind. -- The Elkhart Police Department reports officers responded to a burglary in progress around 7:10 a.m. Wednesday at the former CTS building at 1142 W. Beardsley Ave.
The caller, a representative for CTS, told police several people were burglarizing the location.
Officers arrived and set up a perimeter before searching the building.
Police say while searching, a man fled to the roof and then to the roof of the neighboring Formco building at 1100 W Beardsley Ave.
The man, later identified as 41-year-old Matthew Shepherd of South Bend, was apprehended while hiding in the Formco building.
Police say a K9 officer assisted in the apprehension with the K9 being deployed, leading to Shepherd being bitten.
Shepherd was subsequently taken to the hospital for treatment and medically cleared.
Police say during their investigation, officers found a suspect box truck in the 1600 block of Strong Avenue along with another suspect, later identified as 45-year-old Joshua Hays of South Bend.
Police say Hays resisted being detained in handcuffs.
The report states officers applied for and obtained a search warrant for the box truck.
Authorities say several tools and a large amount of copper wire were found inside the truck during the search.
Shepard was arrested and booked into the Elkhart County Jail on preliminary charges of Theft-Prior, a Level 6 Felony, and Resisting Law Enforcement, a Class A Misdemeanor.
His bond was set at $10,000.
Hays was arrested and booked into the Elkhart County Jail on preliminary charges of Resisting Law Enforcement Resulting in Injury, a Level 6 Felony, and Theft, a Class A Misdemeanor.
His bond was set at $5,000.
Both arrests have been forwarded to the Elkhart County Prosecutor’s Office for review of formal criminal charges.
