SOUTH BEND, Ind. -- After being arrested on Thursday, South Bend Police Department officer Emanuel Garcia is now facing formal charges from the St. Joseph County Prosecutor's Office.

Authorities say the evidence, which included video, was reviewed by a Judicial Officer who found probable cause for the following charges: 

Official charges:

  • Count I: Criminal Confinement, a Level 6 Felony
  • Count II: Domestic Battery, a Level 6 Felony
  • Count III: Resisting Law Enforcement, a Level 6 Felony
  • Count IV: Domestic Battery, Class A Misdemeanor
  • Count V: Resisting Law Enforcement, a Class A Misdemeanor
  • Count VI: Criminal Mischief a Class B Misdemeanor
  • Count VII: Interference with Reporting of a Crime, a Class A Misdemeanor

Sentencing parameters:

  • The sentencing range for a Level 6 Felony is 6 months to 2.5 years.
  • The sentencing range for a Class A Misdemeanor is 0 to 365 days
  • The sentencing range for a Class B Misdemeanor is 0 to 180 days.

Garcia's arraignment is scheduled for 1 p.m. on March 3 where the court will determine any bond.
