SBPD search for 25-year-old man charged in October murder of Miami Hills Apartments resident
SOUTH BEND, Ind. -- The St. Joseph County Prosecutor’s Office announced 25-year-old Delvaughn Moore has been charged with the murder of 42-year-old Joyce Montague, of South Bend.
Officers with the South Bend Police Department were called to Miami Hills Apartments in the 3300 block of High Street for a welfare check on Oct. 22, 2024.
Upon arrival, officers said they found Montague unresponsive. She was subsequently pronounced dead.
Anyone with information regarding Moore’s whereabouts is asked to contact the SBPD at 574-235-9201 or submit an anonymous tip through Michiana Crime Stoppers at 574-288-STOP.
Authorities say Moore does not have a permanent address but is believed to be in the St. Joseph County area or the Detroit area.
Moore is described as 5 feet 9 inches, and approximately 165 pounds with black hair and brown eyes.
BACKGROUND
The St. Joseph County Prosecutor’s Office also released the Probable Cause Affidavit (PCA) for Moore which includes investigation details and Montague's cause of death.
On Oct. 22, 2024, SBPD was contacted for a welfare check on Montague on S. High Street, however, police say she was not found during initial attempts to locate her.
Documents state it was found that the first welfare check call came from Montague's phone number, however it was not her on the 911 recording.
Police then responded to the same address regarding individuals finding Montague dead inside her apartment. She was found underneath a bed in the bedroom.
On Oct. 24, an autopsy was completed on Montague. Documents state her cause of death was a ruled a homicide with injuries consistent with strangulation and blunt force trauma.
The investigation determined Montague had arrived at her apartment the night of Oct. 21, with witnesses telling police that Moore was also at Montague’s apartment that night.
Police then obtained video evidence that corroborated the witnesses’ statements.
The PCA states on the morning of Oct. 22, Moore was captured on video leaving the apartment with multiple bags on a bicycle.
Police say video was checked between the time Montague and a witness arrived at the apartment on the night of Oct. 21, through when Moore left on the morning of Oct. 22, and no other individuals were seen coming or going from the apartment.
Court documents state that Montague's cellphone was not found at the scene, so investigators obtained the call detail records from her service provider.
According to authorities, the records showed the cellphone leaving the area of Miami Hills around the time that Moore is seen leaving on the morning of Oct. 22.
Records showed the phone heading to the downtown South Bend area, Mishawaka, Granger, and then heading to the area of Edwardsburg, Mich.
Investigators then located video footage of Moore from businesses along this path of travel that lined up with the records.
Court documents state that individuals had received text messages from Montague’s phone prior to her being found dead.
Police say these text messages happened after Montague's phone and Moore left the Miami Hills area on the morning of Oct. 22. Investigators say the text messages appeared to be Moore acting as if he was someone else.
Police say the messages said that Moore had left with Montague’s son, which was inconsistent with video evidence, that Montague and the guy she was with were dead, and that “'we' put her up."
On Oct. 25, a Facebook wall post was made on Montague' Facebook page, which included nicknames that were found in the text messages that were sent from her phone number on Oct. 22.
Documents state this Facebook post also ended with “…we ain’t stopping till I see y’all die”.
Montague's Facebook records were then obtained by detectives, and it showed the IP addresses on Oct. 25 were consistent with IP addresses found in Montague's phone records on that date.
Authorities have attempted to locate Moore but have so far been unsuccessful. On Oct. 25, investigators attempted to communicate with Moore via Montague's phone number.
Police say the person who responded used the same nicknames as the texts with Montague's number on Oct. 22.
The person also claimed that Moore was dead but wouldn't explain how this happened or where he was.
