Michigan families suing health department, schools over mask order

BERRIEN COUNTY, Mich. -- Three families are suing the Berrien County Health Department and several schools over the school mask public health order issued on September 1.

The lawsuit calls the order unenforceable, ambiguous, vague, lacking legal authority and abuse of discretion.

They allege state legislators illegally delegated their authority to unelected local health officers and dispute the fact COVID-19 impacts children, even though children are affected by the virus.

The health department reports coronavirus cases among students and staffers have gone down 50-percent since the mask order went into effect.

This week, a judge denied a request for a preliminary injunction to prevent the mask order from taking effect.

The next hearing is set for September 30.
