SOUTH BEND, Ind. -- A South Bend man that was arrested and charged for the 2007 murder of his wife is no longer in custody.

Lucio Lerma was previously being held without bond until Friday, June 26. He was released on his own recognizance.

He was charged in March for the murder of his wife Delia Lerma in December of 2007.

Court records say the prosecution objected to his pre-trial release. The court also ordered both the prosecution and defense to check on the availability of potential witnesses to avoid unnecessary delay in the trial.

Lerma's jury trial is scheduled to start November 16.
