UPDATE: South Bend Chocolate Company responds to injunction denial in airport lawsuit

UPDATE: The South Bend Chocolate Company responded to the injunction denial from the court. In a statement, SBCC president Mark Tarner said the company is disappointed in the ruling but emphasized that "the judge did not rule on whether the bidding process itself was fair or legal." Tarner says he maintains confidence in the case's merits.

SOUTH BEND, Ind. -- A St. Joseph County Superior Court judge has declined to set a preliminary injunction motion in the South Bend Chocolate v. South Bend International Airport lawsuit.

The plaintiffs, South Bend Chocolate Company, INC. and Mark Tarner, requested the injunction to stop the St. Joseph County Airport Authority from allowing the current lease agreement to end, which expires on May 31.

According to the court order filed on May 22, Tarner's goal was to extend the lease during the ongoing lawsuit against the airport regarding the process and selection of new concessionaire/tenant.

The South Bend International Airport has requested the court to dismiss the lawsuit.
