Elkhart parents sentenced for death of 6-month-old

Elkhart County Jail

ELKHART COUNTY, Ind. -- A mother and father will spend decades in prison after pleading guilty for the death of a six-month-old baby.

Owen Miller and Nichole Neely both received a 40-year sentence, with 17 years and 182 days of probation and 968 days of jail credit. That means the two will spend just under 21 years behind bars. They pleaded guilty to Neglect of a Dependent Resulting in Death, a felony.

The incident happened in January 2024. Officers were called to a home on Idlewild Avenue in Elkhart after Miller ran to a neighbor's house seeking medical help for the infant.

Neely reportedly found Miller and the baby on the bed, with the baby limp and not breathing. The baby later died at Elkhart General Hospital.

The home was reportedly covered in trash, with rotten food and strong odors also found.

Neely later told officers the baby was born premature at home, and that she breastfed him and supplemented that with formula. Officers also observed signs of drug use on her body.

The cause of the baby's death was determined to be acute fentanyl and methamphetamine toxicity.

Two other children were in the home; they were treated for accidental fentanyl poisoning.
