Civil rights attorney hired by family of elderly woman who died in Tim Hortons fight

FORT WAYNE, Ind. -- A prominent civil rights attorney will represent an elderly woman who died after a fight at a Fort Wayne fast food restaurant.

According to WRTV, our ABC reporting partners in Indianapolis, Ben Crump will represent 75-year-old Anita Grayson. Crump previously represented high-profile civil rights cases including those of George Floyd and Breonna Taylor.

Grayson died May 13 after a fight with employees at a Tim Hortons. Surveillance video shows Grayson entered the restaurant to address an issue with a drive-in order, which escalated into a fight with two employees. After the fight, Grayson lied on the floor, where she was ultimately found unresponsive.

In a press release, Crump said the following: 

Anita Grayson was a 75-year-old mother, and her family is grieving a sudden and painful loss. They have urgent questions about how a visit to a neighborhood coffee shop ended with the loss of their loved one, and they deserve clear, complete, and timely answers. We have been retained to stand with the Grayson family to make sure their voice is part of this process, and to see that this investigation is thorough and fair. Our focus is on supporting this family and on making sure the truth is established.

The Allen County coroner's office says the cause of Grayson's death is still under investigation.

Fort Wayne Police responded to public outcry over the situation with the following statement:

(We) understand the public concern surrounding this case. We also recognize the importance of transparency, accuracy, and allowing the investigative and prosecutorial review process to proceed based on the full body of evidence, not incomplete video clips or inaccurate public narratives.

Representatives from Tim Hortons tell ABC57 that this location is closed for the time being. The franchisee plans to reopen, but there is no known time window.
