Houses evacuated, SWAT called following domestic violence call with shots fired

UPDATE: A probable cause affidavit obtained from Elkhart County Court reveals the circumstances leading to the arrest of 35-year-old Shane Angel.

Angel has been charged with Battery by Means of a Deadly Weapon (Attempt to Commit), a Level 5 Felony, Battery Resulting in Moderate Bodily Injury, a Level 6 Felony, and Criminal Recklessness Committed with a Deadly Weapon, a Level 6 Felony.

Goshen police responded to 406 Maple Ct. around 10:49 p.m. on July 29 regarding a domestic altercation with shots fired.

Officers arrived to find the caller and his juvenile son in the roadway. The two were then taken to safety at the police department. Police then attempted to contact Angel, the suspect, who refused to leave the residence.

The caller, who was also the victim, told police Angel had an alcohol problem and had been drinking a lot that day. The victim said Angel had become upset that day after accidentally denting his car door.

The victim stated he was in the kitchen with another witness when Angel fired a round from his handgun out the front door of the home.

The victim told police Angel's juvenile daughter was in the dining room at the time. The victim told Angel this upset him. The victim's son was also in the basement at the time, which the victim told Angel.

The victim said at this time Angel headbutted him in the face.

Investigators say they observed an injury to the bridge of the victim's nose and both wet and dried blood. Authorities also observed an injury to the victim's left ear which had wet and dried blood on it. The victim did not know how he obtained the injury to his ear.

Documents state after that the victim told his son to get his things, and that they were leaving.

When the victim and his son were outside in the driveway, the victim said Angel opened a window of the residence and fired a handgun in his direction.

The victim said he saw the round hit the driveway while he was standing in the driveway between the house and his car with son was on the opposite side of the car. That's when the victim called 911 and waited in the roadway.

Police were informed Angel had fired a Tiffany blue handgun. Police were also informed Angel had two handguns and an AR-15.

After several hours of negotiating, Angel exited the house and was detained. A search warrant was later obtained for the home to search for evidence.

The search warrant was executed on July 30, during which investigators located a Tiffany blue and black SCCY 9mm handgun on the bottom shelf of a ladder bookcase in the dining room.

Police say they also found the far-left living room window, which overlooks the driveway, was unlocked and could slide open. The screen was not in the window frame and observed to be leaning up against the wall to the left.

Outside of the house, below the living room window, investigators found a spent 9mm Luger casing in a plant.

The other adult witness at the house was later interviewed and gave contradictory statements and stated Angel was kicking the victim house since he believed him to have started doing drugs again.

She added that Angel and the victim had a "scuffle" and that they wrestled all the time.

ORIGINAL STORY: GOSHEN, Ind. -- The Goshen Police Department reports on Tuesday around 10:49 p.m., they responded to 406 Maple Ct. after a call about a physical domestic fight with shots fired.

Upon arrival, officers located the victim, a 39-year-old man, standing in the roadway and bleeding from the face. The man complained of pain but refused medical treatment.

Nearby homes were evacuated due to the report of shots fired.

The suspect refused to leave the Maple Court home, and the Elkhart County SWAT team was called to assist. Negotiators worked to get the suspect to leave the home.

After several hours, 25-year-old Shane Angel, a resident of the Goshen home, was taken into custody.

Police found evidence of a firearm being discharged, though no evidence of property damage was found.

Angel is charged with Criminal Recklessness with a Deadly Weapon and Domestic Battery in the Presence of a Minor.
