Murder charge dropped against man after key witness in 2022 homicide unable to be found

SOUTH BEND, Ind. -- The St. Joseph County Prosecutor's Office announced a judge has dismissed the Murder charge against Marquis Duncan.

Duncan was arrested in February 2024 in connection with a 2022 homicide.

The prosecutor's office said investigators have been unable to find a key witness who is necessary for the trial.

Officials say due to Indiana Criminal Rule 4, the office must abide by a certain number of days for trial to begin.

The office has dismissed this case without prejudice, which means that they can refile it at any time.

Officials say they discussed the dismissal with the victim’s parents prior to the decision and they understand the reasons.

Investigators and the prosecutor's office say they're continuing to work this case.
