Man accused of burglarizing Elkhart business that was recently victim of thefts

ELKHART COUNTY, Ind. -- Police made another arrest for alleged criminal activity at Toasted Turtle Tavern, which previously reported thefts in October of 2025.

In this case, 48-year-old Derrick Burrington is charged with one count of Burglary, a Level 5 Felony.

According to court documents, the Elkhart County Sheriff's Office was called just before 8:30 a.m. on Tuesday for a burglary report. The front door's glass was shattered and a shed at the rear of the restaurant was found forced open with noticeable damage.

A deputy on scene spoke to the caller who said she left the restaurant at 4 p.m. the previous day and returned to find the damage. The deputy looked at surveillance camera video which showed a man wearing a camouflage coat at the property around 4:30 a.m.

The man, later identified as Burrington, is seen grabbing a shovel and using it to break into the restaurant's shed. He then rummages through the shed and throws some items outside. Burrington allegedly brings the shovel to the front of the building and smashes the glass. The camera then captures Burrington walking north, while the shovel is seen lying on the front patio.

During the investigation, the deputy recalled encountering a man wearing the same clothing as Burrington and matching his description just two hours after the alleged burglary began. Law enforcement was called because the man was standing in traffic and yelling. He was then taken to the hospital via ambulance after complaining of frostbite on his feet.

After identifying Burrington as the suspect in the burglary, he was located in the emergency room lobby at Elkhart General Hospital. There, he was placed under arrest and taken to the Elkhart County Correctional Complex. Burrington told officers that prior to going to the hospital, he was heading to his friend's house where he had left his shoes because they were soaking wet. He denied breaking into the restaurant.

Court documents show that the owner of Toasted Turtle Tavern totaled the damages from the incident, which added up to approximately $4,100.
