BERRIEN COUNTY, Mich. – A lawsuit filed against the Berrien County Health Department could be dismissed after Judge Denis Wiley gave plaintiffs two weeks until a decision will be made.
Thursday morning Judge Wiley made the decision to wait to see if there is anyway the plaintiffs can sue the Health Department since the mask mandate was rescinded on Thursday.
Some schools are still putting their own mandates back in place, leaving some parents unhappy.
“I’m frustrated as a Saint Joseph parent because the schools in our area have made masks optional and our district has not … I think parents should have a choice. The doctors should have a say in what’s happening to these students, and the board of education are not medical doctors,” Jami, a parent of a St. Joseph student said.
If the lawsuit against the health department is dismissed, the plaintiffs will have to sue individual school districts instead.
