Warsaw man charged after allegedly sexually assaulting woman with disabilities

KOSCIUSKO COUNTY, Ind. -- A 57-year-old man from Warsaw has been charged with sexually assaulting a woman with physical and mental disabilities.

The 57-year-old man, Everett Compton, has been charged with four counts of Rape when victim is mentally disabled or deficient as Level 3 Felonies and one count of Sexual Battery as a Level 6 Felony.

On Friday, Apr. 24, the Warsaw Police Department received report from an Adult Protective Services employee, requesting a welfare check on a physically and mentally disabled woman who had allegedly been touched sexually.

Throughout the ensuing welfare check and a subsequent interview at the Warsaw Police Department, the officer found the victim to have physical limitations, struggle with eye contact and articulating responses, and appear child-like and limited in her ability to describe events, times, and places.

During the police interview, the victim allegedly disclosed that Compton had touched her and had sex with her, and that she felt like she had to say yes to him. She also noted that he told her not to tell anyone and that he would no longer be her friend if she did. Another who knew the victim later said that they didn't believe the victim could consent to sexual activity due to lack of understanding.

That same day, Compton was brought to the department for an interview where he was read his Miranda Rights, which he waived to speak with the officer.

According to the probable cause affidavit, Compton assumed he was there for his "behavior" with the victim, stating that he wasn't forceful with her, that she was "needy", and that they had both been drinking.

Compton also allegedly said it was his fault and that he's an adult.

Compton's initial hearing was on Thursday, Apr. 30. He has a status conference on Thursday, May 28.
