Man accused of murder in Ohio caught in Marshall County

UPDATE: Following a five-day trial, a Delaware County, Ohio jury found 32-year-old Brandon Toleque guilty of 2 counts of Murder, both unclassified felonies, with Firearm Specifications, one count of Kidnapping, a felony of the first degree, and one count of Rape, also a felony of the first degree, on May 7.

Court documents state Toleque shot and killed a guest in his Powell, Ohio home in November 2023.

Following the murder, documents state he then forced another guest to leave with him as he fled the Central Ohio area.

Court documents go on to state Toleque sexually assaulted this individual as he drove across Ohio before he was ultimately stopped by police in Marshall County, Ind.

A sentencing hearing was held at 3:15 p.m. Monday.

ORIGINAL: MARSHALL COUNTY, Ind. - A man accused of murder in Ohio was captured by the Marshall County Sheriff’s Office after a pursuit Monday morning.

Brandon Toleque, 31, was arrested by law enforcement at a gas station in Wanatah in La Porte County.

According to the investigation, Marshall County officers tried to pull over the vehicle Toleque was in for speeding around 6 a.m. near U.S. 30 and Michigan Road. A chase began after the vehicle did not stop, police reported.

During the chase, officers said they saw the passenger of the vehicle try to get out multiple times. When it ended, the passenger told police she was transported against her will, according to reports.

Toleque was booked in Marshall County for resisting law enforcement, criminal confinement, reckless driving and possession of cocaine or a narcotic drug.

His murder charge is out of Delaware County, Ohio, which is just north of Columbus.
