Dustin Pate charged with Attempted Murder and ten other counts

ST. JOSEPH COUNTY, Ind. -- The St. Joseph County Prosecutor's Office has charged 34-year-old, Dustin Pate, with attempted murder and ten other counts from the incident that occurred on S.R. 23 and Gumwood Road on Jan. 19. 

The Prosecutor's office charged Pate with the following: 

  • Two counts of Attempted Murder, a level one felony 
  • Two counts of Resisting Law Enforcement, a level five felony 
  • One count of Disarming a Law Enforcement Officer, a level five felony
  • One count of Battery by Means of a Deadly Weapon, a level 5 felony 
  • One count of Attempted Residential Entry, a level six felony
  • One count of Attempted Auto theft, a level six felony 
  • One count of Intimidation, a level six felony 
  • One count of Striking a Law Enforcement Animal, a Class A misdemeanor 
  • One count of Failure to Remain at the Scene of an Accident, a Class B misdemeanor 

Mishawaka Police Department lead the investigation for this case due to the interlocal agreement between SJCPD, MPD, and SBPD. 

Two officers were placed on administrative leave, and not due to the officers being under investigation.

Pate is currently in custody at the St. Joseph County Jail and will be arraigned on Wednesday, Jan. 21, at 1 p.m.
